I have a pretty good NyanCatMD_2.bin file for my Picodrive on my GCW Zero already, and it does play the tune.

Yes. Quoting Wikipedia:

In May 2013, Christopher Torres and Charles Schmidt, the creators of Nyan Cat and Keyboard Cat respectively, jointly sued 5th Cell and Warner Bros. for copyright infringement and trademark infringement over the appearance of these characters without permission in the Scribblenauts series of video games. Torres and Schmidt have registered copyrights on their characters and have pending trademark applications on the names.

Mmm, that's weird, maybe that lawsuit was based on the game being a paid game (or any bussiness model that would make people spend money). The company was getting a benefit using those things.

If you search "nyan cat" you'll find a lot of flash games about it and I doubt that they're made by the nyan cat author or have asked for permission.

Indeed, I did not ask for permission either, only used the animation with the understanding that it was not a commercial use :)
