ok decided to give this a go again, checked out your file Zak, It probably works but I got an error.
I think it's because I had already used that quick fastboot/adb installer and was probably conflicting.
I looked at command lines did'nt see a way to kill the old adb daemon.
Anyway I came across one that works

http://forum.xda-developers.com/showthread.php?t=2061063This whole time I was thinking it was my driver's problem, where it appears to be the adb program.. I don't understand what's so special about about that build.
As for the driver im using the one from:
RK driver assistant,
http://www.cnx-software.com/2013/11/08/simplified-method-to-install-rockchip-usb-drivers-in-windows-xp78/It's meant to be run as an install but I noticed the drivers are just sitting there so Instead I just pointed windows to that folder and let install on it's own.
Before that I had been using a universal driver from:
http://adbdriver.com/Which might work but I'll never know now since I thought THAT was the problem.
Now how the hell am I gonna get fast boot working? it's my understanding it's useful at a lower level then adb and can be useful for recovery.
EDIT: Ah I see the command now to kill the adb server.. "adb kill-server"
